The plaintiff, a 37-year-old resident of Belleville, New Jersey, was in Wallington, New Jersey, when her vehicle was struck from behind by another automobile at a high rate of speed. Investigation at the scene revealed that the driver of the other vehicle was intoxicated.

The plaintiff suffered multiple injuries to her cervical and lumbar spines as well as diminished hearing loss in one ear and dizziness and underwent extensive medical care for these injuries. Ultimately, she required numerous pain management injections and procedures for her persistent neck and back injuries. She eventually underwent endoscopic discectomy surgery on her cervical spine.
