December, 2024 – Our client was the mother of a member of the social club in Roxbury, The Shongum Club, who had previously frequented the location with her family while visiting them as an invited guest. Pursuant to club policy, members and their families were expressly permitted to use the barbeque cooking facilities and utensils at the club to prepare food and enjoy the offered recreation. Our client was injured on a hazardous set of stairs in the kitchen, when she sought to retrieve cookware provided by the club, kept in an entryway to the basement, which remained unlocked. Upon entering the unlit doorway, she encountered a set of stairs that were found to be extremely dangerous by the unchallenged engineering expert our firm obtained. She fell down the entire flight of stairs, sustaining severe head trauma, resulting in an irreversible brain encephalopathy, causing that part of her brain to die. A CT scan at the hospital revealed a subarachnoid hemorrhage in the bilateral frontal lobes, and contusions in the front right and left temporal lobes. All her head injuries were confirmed by a leading expert in the field. She sustained a fractured wrist. Settlement was reached for the full policy limits following discovery and exchange of expert reports, prior to arbitration or trial listing.
