Settlement for $105,000 for basketball spectator who falls on improperly opened middle-school bleachers in Sussex County.

February, 2021 – Ana Rita Ferreira and Amos Gern achieved a $105,000 settlement on behalf of a Sussex County father who went to watch his son play a basketball game at a public middle school, and fell from the bleachers which were not properly extended. As a result, our 55-year old client, an office equipment salesman, was disabled for 8 weeks, after undergoing extensive surgery to his left leg for a left knee quadriceps tendon repair for full-thickness patellar articular cartilage defects. He remained on crutches and a knee mobilizer for a significant period. Our client had a prior ACL repair to the opposite knee, years before, and the impact of a bilateral knee injuries was quite debilitating. Pre-trial discovery uncovered a video tape of the aftermath of the incident as our client was being attended to by EMS, and a witness captured a photo of the defective step separation on the bleachers.
