Amos Gern and Stewart Miller settled an injury claim for $150,000 for a 46-year old Morristown army base librarian.

December, 2023 – In the early evening of November 15, 2022, our pedestrian client was thrown 20 feet after being struck by a car. She was taken by ambulance to Morristown Medical where she was treated for six days. She underwent multiple sessions of physical and occupational therapy, requiring assistance with most bodily functions. Home physical therapy was initiated to ween her off the need for a rolling walker, followed by active orthopedic assessment, two MRI studies, and an additional course of PT.  Her pelvic MRI revealed a displaced fracture of the left superior and inferior pubic ramus, with bone marrow edema indicative of subacute fractures. A lumbar spine MRI found acute left S1 edema at the L5 facet joint pedicle, suggesting a fracture, and a central and left L5/S1 disc herniation. This required an epidural spinal injection at that vertebral disc to address her on-going pain and limitations. Due to our aggressive approach to the claim, we recovered the $100,000 policy limits of the driver’s NJM Insurance, and another $50,000 from our client’s Under-Insured Bodily Injury coverage with USAA, both without the necessity of filing suit in court.
