July, 2022 – In this accident, our client sustained a concussion, and multiple spinal injuries. MRI studies of the head, cervical and lumbar spines, reflected the following: a small brain hemorrhage, broad-based and right central disc herniations at C3-4, disc bulging at C4-5 and C5-6, with an associated central disc herniation at C5-6, and disc bulging at L4-5 and a disc herniation at L5-S1. He treated initially with a chiropractor, and was referred for pain management care, following an EMG of the upper extremities, which was consistent with right C5-6 radiculopathy. He then was administered multiple epidural injections. Additionally, an orthopedic spinal surgeon opined that he had a central annular tear at L-5-S1 and would eventually be an excellent candidate for an anterior lumbar interbody fusion. We were able to settle the claim against the responsible driver for his policy limits of $25,000. We then sued NJM Insurance, our client’s Underinsured Bodily Injury carrier, and asserted a “bad faith” claim per a recent NJ statute that authorized such claims. This led to a further settlement of $150,000 paid from our client’s policy.
