April, 2022 – Our client had extensive treatment for lower back herniated discs, severe neck herniations, related neurological injuries, and psychological issues. Although she had some pre-existing conditions from prior accident claims, none were significant or related. The most difficult aspect of the litigation involved the continued denial of no-fault benefits (PIP), until we were able to convince a neurosurgical examiner of the causal relationship of her cervical spine injuries to the MVA, by referencing numerous C-Spine MRIs, and a continuing course of related treatment. A cervical discectomy and fusion from C5 to C7 was eventually approved and performed in late March 2022, convincing the defense counsel to settle for the policy limits, and avoid a bad faith claim. We had to address many insurance issues throughout the litigation, including a substantial Medicaid lien.
