We have first hand experience litigating medical malpractice cases involving catastrophically injured infants suffering brain damage because of negligent delivery procedures. We have represented victims and estates because of negligently diagnosed cancer. We have also obtained verdicts and settlements for medical malpractice victims in cases involving negligently performed eye surgery, negligent post-operative care, negligent supervision of hospital staff , negligent cosmetic surgery, negligent cardiac surgery, negligent arterial stenting surgery, and negligently treated vascular insufficiency.

At the same time, we have a substantial products liability practice. Our attorneys have obtained a multi-million dollar verdict against a manufacturer of a fuel pump that was improperly installed due to inadequate instructions. Additionally, we have settled cases involving allegations of defectively designed machines, inadequately installed safety guards and failure to provide appropriate warnings on industrial machinery.

The firm has extensive experience in the litigation and trial of accounting, architectural, engineering, legal, medical, dental, real estate broker and insurance agent malpractice actions in the state and federal courts, and in arbitration, mediation and other forms of alternative dispute resolution. We also represent clients appearing before professional administrative and state licensing boards. In addition, we evaluate insurance coverage issues in the context of professional malpractice matters.

Amos Gern chairs the Complex Tort Practice section at Starr, Gern, Davison and Rubin, P.C. He has more than 30 years is experience in trying complex tort cases. Mr. Gern is a former Assistant United States Attorney, and certified by the New Jersey Supreme Court as a Civil Trial Attorney and by the National Board of Trial Advocacy. Mr. Gern is an officer of the Association of Trial Lawyers of America, New Jersey Chapter and a member of its Executive Committee. He is a frequent lecturer at programs for other trial attorneys.

Recent successes of the Complex Tort Practice section include:

  • Amos Gern, assisted by John Ratkowitz, obtained a jury verdict for $17 million on behalf of a patent attorney who was the victim of negligent eye surgery and an additional $3.5 million for his wife.
  • Evan Goldman obtained a $2.5 million jury verdict in a products liability case where a fuel pump which was improperly installed due to inadequate instructions resulted in an explosion causing substantial injuries.
  • Amos Gern, assisted by John Ratkowitz, successfully litigated a medical malpractice case for $1.235 million. The case involved a client who lost his sight as a result of negligent post-surgical treatment following open heart surgery at a local hospital.
  • Amos Gern, assisted by John Ratkowitz, obtained a $1.2 million verdict in a medical malpractice case involving a failure to diagnose vascular insufficiency and negligent arterial stenting.
  • Amos Gern successfully recovered $1 million on behalf of a trial attorney who suffered a closed head injury and fractures in an automobile accident.
  • Amos Gern recovered $835,000.00 on behalf of a 32 year old man who required cervical spine surgery as a result of injuries sustained in an automobile accident.
  • Amos Gern recovered $750,000.00 in a wrongful death case for an 87 year old man who was seriously injured in a motor vehicle accident and died of a stroke which developed from subsequent injuries.
  • Amos Gern recovered $725,000.00 on behalf of a 33 year old truck driver who suffered a hip fracture after being involved in an accident with a tractor-trailer.
  • Amos Gern, assisted by John Ratkowitz, obtained a $675,000.00 settlement on behalf of an ironworker who sustained spinal injuries during a construction accident.
  • Amos Gern, with the assistance of Allan Mordkoff, recovered $670,000.00 on behalf of a 72 year old woman who suffered a hip injury in an automobile accident.
  • Amos Gern resolved an intrastate truck accident case on behalf of several members of the same family in the amount of $625,000 at trial.
  • Amos Gern, with the assistance of John Ratkowitz, settled a case at trial for $600,000.00 on behalf of a victim of negligent retinal surgery.
  • Amos Gern recovered $500,000.00 for a 63 year old man who developed a stroke one month following a motor vehicle accident, where the medical causation was strongly contested.
  • John Ratkowitz recovered $450,000 on behalf of a passenger on an interstate bus who sustained a hip fracture when he fell while exiting the bus while it was still in motion.
  • Amos Gern recovered $355,000.00 on behalf of a woman who injured her hand in a die press machine.
  • Evan Goldman recovered $325,000 in a products liability case for a person who sustained a serious eye injury due to an improperly guarded machine.
  • Evan Goldman recovered $175,000 in a wrongful death case against a Nursing Home on behalf of the estate of a woman who choked to death when she was fed in a manner contrary to the guidelines of the restricted diet she had been prescribed.
  • John Ratkowitz recovered $145,000.00 on behalf of a victim of negligent cosmetic surgery.
